The services available at http://www.shop4law.co.uk, herein referred to as the "Site" are owned and operated by Shop4Law Limited, registered in England (Registration Number 5437223) herein referred to as the "Company", and are provided to the consumer, herein referred to as the "Requestor" and the Lawyer, herein referred to as the "Member".
If you do not agree to be bound by the terms and conditions of this Agreement, do not use or become a member with our services. Shop4Law may amend this Agreement at any time by posting the amended terms and conditions on the Site.
In consideration of the covenants specified below and on any official attachments, the parties for themselves, their successors, and assigns mutually agree hereto:
1. SERVICES. The Company offers a Requestor to Member marketing platform. The site provides those seeking legal services with the opportunity to locate Members who are interested in providing legal services to the Requestor. "Service" to Members of the site.
2. USER ASSUMES REPONSIBILITY. The Company does not warrant the validity and accuracy of information submitted by Requestors or Members. The Company does not guarantee the quality of any work product by Members.
3. CONDUCT. You agree to provide true and accurate information when using the site. You may use another member's email address or the name of another individual when using this site and agree to notify the company immediately of any unauthorized use of your email or any other breech of security. The company will not be liable for any loss or damage arising from your failure to comply.
You agree not to use this service:
- To transmit, post or otherwise make available any unsolicited or unauthorized advertising, promotional materials, "junk mail", "Spam," "Chain letters," "pyramid schemes," or any other form of solicitation;
- To 'stalk' or otherwise harass another;
- To distribute viruses, corrupted files, or any other similar software or programs that may damage the operation of another's computer or telecommunication equipment.
You agree that the Company responds your requests and postings and that the company has the right to deny any request or remove any content that is in violation of these terms and conditions.
4. DISCLAIMER OF REQUESTOR-MEMBER RELATIONSHIP AND LEGAL REPRESENTATION. Use of this Service is not intended to and does not create Lawyer/Client relationship between a Member and any Requestors. Establishment of a Lawyer/Client relationship must occur outside the scope of this Service. The Service offers no legal advice, recommendations, endorsements, or legal representation of any sort. The Service offers Requestors a means to review a limited choice of legal counsel. The Company does not practice law, nor provides legal services. Each Requestor is solely responsible for making his, her or its own selection of counsel. The Company does not charge Requestors a fee to use the service and does not receive any portion of any legal fees or costs charged by any Member and legal services are strictly between the Requestor and their Member and do not involve the Company in any way. The Company allows Requestors to find a Lawyer Member for free. The Company is aware that legal services will not be free of charge. The Legal fees may be incurred by the Member and hereby releases the Company from the responsibility of those legal fees.
5. DISCLOSURE. Because of the nature of the Internet any and all information provided through this Service is subject to interception by third parties. By continuing to use this Service you hereby acknowledge that disclosure of electronic communications sent through the Service may occur. Therefore, Requestors should avoid disclosing any privileged and/or specific information regarding matters for which legal representation is sought. Specific information would include, by way of example only, names of persons, businesses, and facts that would readily identify the parties involved in the legal issue or dispute. Requestor should describe their issue or dispute in the general terms only. Specific information should only be revealed after the Requestor has selected a Member and made contact outside the Service (e.g. via telephone or appointment). Members using the Service should refrain from asking any Requestor to reveal any specific or confidential information through the Service.
6. DISCLOSURE OF INFORMATION. The Requestor hereby agrees that by releasing their name and telephone number to a Member, that they acknowledge that they are willfully providing their name and telephone number in an attempt to initiate contact with one or more of the Members. Requestor understands that by accepting these terms and conditions, he/she agrees that the Company and the site are not responsible for any legal advise or information given by a Member who elects to contact you and understands that by releasing your name and telephone number hereby forfeits your privacy and anonymity under these terms and conditions.
7. SOLE DISCRETION WITH REQUESTOR AND MEMBER. Member acknowledges Requestor has discretion whether to contact any Member who responds to a request. The Company does not and will not direct a Requestor in the selection of a Member or limiting the ability of a Member to use his or her own judgment in the practice of law.
8. CONFLICTS CHECKS. Member bears sole responsible for checking for conflicts of interest between the Requestor and other clients of the Member. Conflict checks require Requestor to provide their name and contact information and the identity of any affiliated entities, opposing individuals and entities, and such other information as a Member may require. Conflict checks by Members who obtain information from Requestors through this Service are not possible since submissions by a Requestor to the Member are anonymous and the description of the matter by the Requestor is required to be general in nature.
9. COLLECTION OF PII. The Company only collects Requestor's personally identifiable information ("PII") that is provided by Requestor while posting a case for the purpose of seeking legal services. Examples of PII that may be requested include: first and last name, address, email address, and telephone number. In order to allow the Company to comply with applicable legal requirements, Requestors will never be asked for payment or credit card information.
10. USE AND SHARING OF PII. The Company reserves the right to use Requestor PII: (1) for the specific purpose for which such information was provided; (2) as disclosed at the time such information is provided; and (3) as disclosed in this Policy. However, Requestors should note that Casepost.com may change this Policy at any time, and that therefore the Company may in the future use Requestor PII for additional purposes not currently included in this Policy. Also, the Company may share Requestor PII with its partners, sponsors, advertisers, service providers and marketers lookup and reference services and any other entities that the Company believes are able to provide Requestors with special offers and opportunities. Note that although the Company advises everyone who receives Requestor PII from Shop4Law to support this Policy, the Company has no control over such party's information handling practices and is not responsible for any failure of such party to adhere to this Policy. Requestors are required to provide their PII to the Company as a condition of use, and to understand and agree that the Company may share their PII with the Network Sites and unaffiliated third parties. If you do not provide the required PII or do not agree that the Company may share your PII with such entities, you may not register as a Requestor, and if you are already a Requestor, you must immediately terminate your account, by contacting the customer service department. Finally, the Company may disclose Requestor PII in order to: (1) comply with applicable laws; (2) respond to government requests; (3) comply with valid legal process; and (4) protect the rights or property of the Company, the Network Sites or other Requestors of this Site. By registering and using this Site, Requestors acknowledge that the processing of their PII for the purposes described above may involve the transfer of such PII from within the United Kingdom (UK) to countries outside the European Union (EU) whose data protection regulation may not be as stringent as that within the EU.
11. RELEASE. Members and Requestors release, acquit and forever discharge the Company, its directors, officers, employees and shareholders from any and all claims, demands, losses, injuries, liability, or damages of any kind and nature, whether known or unknown, suspected or unsuspected, disclosed or undisclosed, arising out of or in any way connected with the Service, any disclosure resulting from your use of the Service, any conflict of interest, ethical violation, or any alleged malpractice arising out of any Requestors use of the Service in locating a Member.
12. If you send a Lawyer or law firm email through our service, your email will not create a Lawyer-client relationship and will not necessarily be treated as privileged or confidential. Please do not send sensitive or confidential information via this email service. The Internet is not necessarily a secure environment it is possible that your email sent via the Internet. The Lawyer or law firm that you are writing to may not choose to accept you as a client.
13. SOLICITORS INTRODUCTION AND REFERRAL CODE 1990. Shop4Law complies with the Solicitors Introduction and Referral Code 1990, as amended, and the Solicitors Publicity Code 2001. This service is free to Requestors. If any Requestor submitting case details subsequently receives an offer from a Member and that Requestor chooses to instruct that Member, the Member will pay Shop4Law a fee. The fee may vary. The Member will not charge or recover the fee from the Requestor.
