Do I need a Lawyer?

Although you are not legally obliged to use a lawyer in all situations, retaining a qualified lawyer can improve your chances of a favourable outcome in a dispute or provide you with certainty and peace of mind in an adminstrative matter (for example, the drafting of a will).There are many Internet resources available to assist in giving you initial advice and guidance on specific topics. As well as any legal requirement it is important to balance the cost of a lawyer against the issue you have and the solution that you want. What you decide is up to you but you should certainly think about it. Remember that it is often possible to recover some of the initial outlay you spend if your case succeeds against another person but there are exceptions to this, notably in Small Claims cases.

 

Small Claims Procedure

 

If your claim does not relate to an injury and you are likely to be seeking less than £5000 in compensation then it is most likely that it will be referred to the small claims section of the Court. As a general rule of thumb for claims that fall into this category you cannot claim back the legal fees that you incur even if your claim succeeds. You need to carefully consider whether you want to retain the services of a lawyer even if you are sure of the merits of your case.
